Beta Version 5.5 & 5.3 Legal Information and License

November 2003

General License Agreement—RECON Beta versions 5.5 and 5.3

This document pertains to the use of the RECON[tm]. It applies to all executable (binary) files, documentation files, source code, help file and data files contained in official RECON archives. All of these are referred to here as 'the software'.  The DDASSL/RPI Team reserves the right to revise these rules in future versions and to make additional rules to address new circumstances at any time.

All of this software is Copyright 2001-2003 by the DDASSL/RPI Team[tm].

The copyrighted package may ONLY be distributed and/or modified according to the license granted herein. The spirit of the license is to promote the usage of RECON in the spirit of the unfettered exchange of scientific ideas, to collect data on the performance of the software in diverse environments and platforms and its application in diverse situations, to enhance the quality of life of those who come in contact with RECON, while preventing RECON developers from being taken advantage of. This license was created so these goals could be realized. You are legally bound to follow these rules, but we hope you will follow them as a matter of ethics, rather than fear of litigation.

Usage Provisions

Permission is granted to the user to use the software and associated files in this package. The source code, if and where made available, may NOT be modified in any way whatsoever.

General Rules For All Distribution

Permission is NOT granted to redistribute this package or any of the files contained herein under ANY circumstances.

These archives must not be re-archived using a different method without the explicit permission of the DDASSL/RPI Team. You may rename the archives only to meet the file name conventions of your system or to avoid file name duplications but we ask that you try to keep file names as similar to the originals as possible.

Definition Of “Beta Package”

RECON is officially distributed for MS-DOS, Windows 95/98/NT and SGI/Unix platforms.  Other systems may be added in the future.

This Beta version software may NOT be bundled with other software packages.

The DDASSL/RPI Team does not license source code for any use outside RECON.

No portion of the RECON source code may be incorporated into another program.

All executables, documentation, files and descriptions of the same must clearly identify themselves as the appropriate version of RECON. Any attempt to obscure the fact that the user is running RECON or to obscure that this is a Beta version expressly prohibited.

This Beta version of RECON may not be linked into other software neither at compile-time using an object code linker nor at run-time.

The use of RECON is promoted and encouraged in the interests of free exchange of scientific ideas, with no obligation to retain this as a free service for future full versions.

Users are obligated to include appropriate credit for RECON in all publications and results generated employing the software. The appropriate citation is:

Retail Value Of This Software

Although the Beta version of RECON is distributed free of charge within the terms of this agreement, the retail value (or price) of this program is determined as US$100,000.00 per copy distributed or copied. If the software is distributed or copied without authorization you are legally liable to this debt to the copyright holder or any other person or organization delegated by the copyright holder for the collection of this debt, and you agree that you are legally bound by the above and will pay this debt within 30 days of the event.

However, none of the above paragraph constitutes permission for you to distribute this software outside of the terms of this agreement. In particular, the conditions and debt mentioned above (whether paid or unpaid) do not allow you to avoid statutory damages or other legal penalties and does not constitute any agreement that would allow you to avoid such other legal remedies as are available to the copyright holder.

Put simply, the Beta version of RECON is only free if you comply with our conditions of use; it is not free otherwise. The copyright holder of this software chooses to give it away free under these and only these conditions.

For the purpose of copyright regulations, the retail value of this software is US$100,000.00 per copy.

Other Provisions

There are no restrictions on use of the data generated by RECON.  The team permits and encourages the creation of programs, including commercial packages, which import, export or data generated by RECON.  We reserve the right to add or remove or change any part of the language.  Your receipt of this license agreement and use of the software thereafter constitutes your acceptance of all terms, conditions and provisions herein.
